Mediator skills for Medical Negligence and Personal Injury Disputes - FOR MEDIATORS

What does this course achieve?

This one-day course offers accredited mediators the opportunity to develop skills to mediate in the medical setting. The course will be facilitated by Tony Allen, the most experienced medico-legal mediator in the UK, and experienced Conflict Dynamics' mediator trainers and coaches. It is well known that the South African healthcare industry is facing a crisis of rising claims against medical practitioners and that medical indemnity providers, insurers and the Department of Health are keen to use mediation to resolve disputes more effectively. Mediation is a process which could be used at almost any stage of a conflict or dispute to address the concerns raised by patients and to achieve better outcomes earlier and at less cost.

Course outline

1. The special features of clinical negligence mediation

  • Creating trust in a new process for those participating
  • Handling emotional content
  • The value of participation for patients and families and clinicians and managers
  • The important role of lawyers on medical as well as legal issues
  • Coping with medical issues – less difficult than it seems?
  • Persuasion and risk

2. Role-play and discussion of the stages of a clinical mediation:

  • Mediator pre-calls to parties
  • Pre-meetings with parties on the day of the mediation
  • Opening the mediation in a joint meeting
  • Exploration and bargaining
  • Bargaining and concluding

This course will be limited to 18 mediators so each participant has 40 minutes to role-play and receive coaching from our experienced mediator coaches

NOTE: This course will be registered with the HPCSA so that participants can earn CPD points by attending.
