Preparing for, Presenting in and Chairing a Disciplinary Enquiry

In your role as a presenter of a case in, and/or chairperson of, a disciplinary enquiry be able to present a case in and/or chair a disciplinary enquiry in an appropriate and fair manner. This course can be conducted over two or three consecutive days or in a modularized format, to meet clients' needs.


  1. As a presenter of a case in a disciplinary enquiry:
    1. conduct an investigation  (in particular through interviews/statement taking), and ensure that all necessary information has been gathered for the preparation and presentation of the case in the enquiry;
    2. draft a properly worded chargeto be put to the employee in terms of the Company’s Disciplinary Procedure;
    3. develop the strategy  for the presentation of the case consistent with the law of unfair dismissal, the Company’s Disciplinary Procedure and the law of evidence;
    4. present the case, in particular opening statements, examination, cross-examination and re-examination and closing statements.
  2. As a chairperson of a disciplinary enquiry, ensure that:
    1. The requirements of the Company’s Disciplinary Procedure have been met;
    2. The procedural requirements for a fair enquiry have been met;
    3. The substantive requirements for a fair and appropriate outcome have been met;
    4. Objections and other procedural issues are dealt with fairly;
    5. The evidence is properly assessed;
    6. A reasoned decision has been made and written.

This course is accredited by the South African Board for People Practices (SABPP) and is aligned to unit standard 11286 Institute Disciplinary Action (NQF occupational qualification level 5, 8 credits) and unit standard 255514 Conduct a Disciplinary Hearing (NQF occupational qualification level 5, 15 credits).
