There are various approaches to conflict management and dispute resolution. Organisations typically apply consensus-based approaches in the case of interest-based disputes and apply adjudicative approaches such as disciplinary processes in the case of rights-based disputes. We have learned through experience in the labour relations field and the work of the CCMA that consensus-based processes can work really well in both interest and rights-based conflicts. 
 
The most common consensus-based approaches are negotiation, conciliation and mediation. The style adopted by the conciliator or mediator is typically facilitative with the aim of reaching a settlement agreement. What opportunities are there for adopting a more transformative approach using principles and processes of Restorative Justice, particularly when mediating rights-based disputes?
