The Department of Justice has issued new draft mediation rules for Magistrates Courts. The rules appear to have been substantially revised since they were first issued in early 2012. The rules are to be supplemented by accreditation standards and a list of accredited mediators to be determined by the Minister of Justice, and a schedule of fees.
The Department has invited comments on the rules to be submitted before the end of May. DiSAC is co-ordinating comment on behalf of the mediator provider community. Conflict Dynamics will contribute to these representations, particularly to ensure that the 'qualifications and standards of fitness' of mediators referred to in the rules is consistent with international standards and best practice.
