John Brand presented a paper at the 2014 FEDUSA Conference on the problem of violence and collective bargaining in South Africa. Against the backdrop of violent inter-union rivalry and the calls to curtail unionisation, collective bargaining and the right to strike, he discusses the rights to freedom of association, organisational rights, collective bargaining, and the right to strike, each of which is enshrined in the South African Constitution. He explains how these rights are legally inviolable and are essential for a free market. He argues that the problem is not the existence of the rights but how they are exercised and regulated.
